The Abortion Enforcement Paradox

The recent Texas provision to support vigilante lawsuits of anyone that gets an abortion is being copied by other states. In fact, the MAGA cult state governments routinely copy abortion laws from other MAGA cult states. You can expect the states proposing laws against contraception to be copied. And laws charging felony crimes for abortion to be routinely copied. The State Legislators of Louisiana proposal to make the women who have an abortion guilty of murder is likely to be copied. It passed out of committee 9 to 7 but failed in full session. MAGA cult will try again. In Louisiana the penalty for murder is death. This year, April 9, 2022, a woman in Texas thought to have had an abortion was jailed and charged with murder. Charges were dropped but so it begins.

Why do these legislators propose these laws? They believe that life begins at conception and that ending the life is murder. Ok, but why the vigilante laws? Well, they don’t trust people to follow the law. People might go out of state to obtain an abortion, or they might obtain abortion medicine by mail order.

The laws proposed have no exceptions for rape, incest or the pregnancy of a 12-year-old child. Also, no provision for the health of the mother, even in the case of ectopic pregnancy where both the fertilized egg and the mother will die unless there is a medical abortion. Why?

The fundamental reason is the MAGA cult believes only they can judge right and wrong. Doctors cannot be trusted to make medical decisions and women cannot be trusted. The doctor might claim it was required to save the mother’s life; he might lie.

Consider the following implications of this lack of trust and belief that people as a whole cannot be trusted to do the right thing.

The single mother with 5 children is told she will die if a pregnancy is not terminated. She is the sole provider for her children. She knows her state is poor and has almost no support for orphaned children, no medical care for them and near zero support for the poor. If she dies, then her children will be left to the state.

With vigilante laws, there is an incentive for the MAGA cult to monitor social media to track pregnancies. This means the state does not need to spend resources monitoring people to determine if there is an abortion. That is very efficient. A woman proudly announces she is pregnant. But she does not give birth within 9 months, so the vigilante mob files a lawsuit and demands information under subpoena. And the state files charges of murder. The woman did not give birth because she had a miscarriage.

There is no way to tell an abortion from a miscarriage. For women charged with having an abortion that was a miscarriage they will need to prove a negative to a MAGA cult jury and deal with vigilante lawsuits attempting to bankrupt their family. Can she prove she did not have an abortion? Lookup proving a negative on the internet if you don’t fully understand this issue.

MAGA cult states have already declared life begins at conception so contraception must be outlawed. Some people might elect to have their tubes tied or the man will have a vasectomy. Of course, they could also have fertilized eggs or eggs frozen so they can have children when they want. How to enforce these soon to be illegal activities? In the interest of potential pregnancies, clearly new laws will be needed. And given the no trust policy certainly those laws should include medical inspections at random times once a year. Perhaps at the police station to make criminal charges more efficient should it be determined that people have violated a law meant to stop the murder of a potential baby.
